On 26th July 2017 the Supreme Court ruled that Employment Tribunal fees are unlawful and have been since their introduction in 2013.
The Government has committed to refunding all fees paid however details of how this will actually be achieved are yet to be announced. The process is likely to be lengthy as in some cases although the initial fee was paid by the Claimant, this may already have been refunded by the Respondent via a compensatory award or costs order. Fees may also have been paid by a third party on behalf of the Claimant and therefore it will take some time to ascertain who the refund should go to.
We are also waiting on clarification from the Employment Tribunals Service as to how the refunds will be processed and managed and as soon as we have more information we will update this page and our social media.
