Retirement and age discrimination

Has your employer told you that it’s time for you to retire?  Are you being discriminated against or forced out because of your age?

In April 2011 the Default Retirement Age of 65 was abolished.  Since then your employer can no longer insist that you retire at this age unless they can justify it to an employment tribunal by a sound business reason, which will be difficult to prove in most cases.  If you didn’t receive a notification of retirement before 6 April 2011 then you can in most cases choose your own retirement date. 

If you haven’t yet reached retirement age, but you feel that your younger colleagues are treated more favourably by your employer because of your age then you may have a claim for age discrimination in the employment tribunal.  Age discrimination awards have no size limit, and if you are unable to get another job this will be taken into account.  If you are being treated inappropriately by your colleagues because of your age, you may decide to raise a grievance with your employer to stop the behaviour.
